NHS Yorkshire and the Humber is committed to supporting organisations in the region to deliver the best quality services for patients and value for money for the taxpayer.  In carrying out this role our aim is to create an environment which is founded on mature local relationships in which organisations cooperate to deliver a seamless service, and in which competition is harnessed appropriately to ensure quality, innovation, value for money and greater choice for patients. 

The principles and rules for co-operation and competition (PRCC) set out the expectations for organisations commissioning or providing NHS funded services.  We will uphold these principles and rules, and support our local organisations to do so. 

We have also worked with our local PCTs and the Department of Health to develop a process to deal with perceived breaches of the PRCC.  This process is based on the principle that disputes should be resolved at the most local level possible:

 

  • The responsible PCT should deal with the complaint in the first instance.  PCTs in Yorkshire and the Humber have published dispute resolution processes for handling the processes locally.  The relevant PCT process can be accessed via the relevant PCT in question.
  • If the dispute is not successfully resolved at this level, there is an option to appeal to the SHA dispute resolution process. 
  • If the complaint is still not successfully resolved, it can be referred to a national Co-operation and Competition Panel (CCP).  The CCP also has ‘reserved matters’ which should be fast tracked direct to the national panel.
